New York Asbestos Removal Requirements for Property Owners

Asbestos work in New York involves requirements for assessment, contractor qualifications, project planning and the handling of affected materials. The requirements depend on the building, location, material and proposed work.

For property owners, the practical starting point is to establish what the project will disturb and have the appropriate asbestos professionals determine the assessment and handling requirements before construction begins.

Arrange an Asbestos Survey Before Construction

New York State Department of Labor guidance calls for an asbestos survey before demolition, renovation, remodeling or repair work. The guidance explains that construction date alone does not remove applicable survey obligations. Where a building or structure has not been adequately surveyed, it must be treated as containing asbestos under the applicable rules.

A certified New York State asbestos inspector should assess the areas your project will affect. Provide the proposed construction scope, including materials that will be removed and concealed areas that workers expect to open.

A survey prepared for an earlier project should be reviewed against the new work. Do not assume it addresses rooms or materials outside its original scope.

Check Contractor Licensing and Worker Certification

New York regulates asbestos contractor licensing and the certification of people working on asbestos projects. Ask for the contractor’s current asbestos handling license and confirmation that personnel hold the credentials appropriate to their duties.

The NYS Asbestos Control Bureau provides information about contractor licensing, worker certification, surveys, notifications and abatement requirements.

Establish Filing and Notification Responsibilities

Applicable notifications must be addressed before work begins. Confirm who is responsible for preparing and submitting them, which project information is required, and how the notification schedule affects the start date.

A contractor’s availability does not establish that every regulatory step has been completed. Ask for a schedule that includes the necessary planning and filing requirements.

Account for New York City Requirements

Projects in Manhattan, Brooklyn, Queens, the Bronx and Staten Island must account for applicable NYC Department of Environmental Protection investigation, filing and abatement rules, alongside state licensing and certification requirements.

Depending on the project, this can involve a DEP-certified asbestos investigator, an ACP-5 assessment, an ACP-7 project notification or additional review. The appropriate route depends on the building and proposed work.

Confirm Independent Monitoring Arrangements

Where New York State rules require project air sampling, the property owner or the owner’s agent must retain an appropriately qualified firm independent of the abatement contractor.

Ask which inspections and monitoring apply, who will perform them and who will provide the reports. Completion requirements should be established before the removal work starts.

Keep Your Project Records

Retain the asbestos survey, laboratory findings, written scope, applicable notifications, contractor project record, waste documentation and required completion reports.

These records help establish which materials were assessed, which areas were included and what work was completed. They can also provide useful background for later renovations.
